Personal Injury

“Personal Injury” claims occur where someone suffers an injury as a result of another’s negligence. Generally, in negligence claims, the party who claims to have been injured must establish that the defendant breached a duty of care to the injured party that proximately caused damages to that injured party.

Personal Injury claims arise in several different contexts, including slip and falls, trip and falls, catastrophic injuries, medical malpractice, industrial disease, defective roads and sidewalks, and airplane, motorcycle, automobile and boating accidents. If you have been injured by the negligence of another person or corporate entity, you may be entitled to compensation for your injuries. Likewise, if a claim has been made against you for personal injuries, you may not be liable for the injuries suffered by others.

Wrongful Death claims may be brought against defendants who may be either negligently or strictly liable, either in whole or in part, for the death of another. Like personal injury claims, wrongful death claims can arise in a number of circumstances, including as the result of motor vehicle accidents, criminal acts, industrial disease, or medical malpractice.
